The NSW Department of Communities of Justice has committed to an initial review of the evidence surrounding the missing Wollongong toddler Cheryl Grimmer.
A NSW Government spokesperson says material provided by the Grimmer family is under review.
The three-year-old vanished from Fairy Meadow Beach near Wollongong in 1970, where she was spending the day with her mother and three brothers.
There were unconfirmed reports she was carried away by a man leading to extensive but unsuccessful searches.
An inquest in 2011 concluded she had died.
After a breakthrough, a man was extradited from Victoria to New South Wales in 2019 to face trial over her abduction and murder, but the case collapsed as it was about to begin.
The court ruled a key piece of evidence provided by the suspect was inadmissible because the accused's police interview from 1971 was ultimately unfair as there was no parent, adult or lawyer accompanying the then 17-year-old.
The accused cannot be identified.
In a statement, the NSW Police said the investigation into the cold case remained open.
"The investigation into the disappearance of Cheryl Grimmer remains under the responsibility of the Homicide Squad's Unsolved Homicide Unit," police said.
"Despite extensive searches at the time and over the years, she has never been found.
"A $1 million reward for information that leads to the recovery of Cheryl's body, and the circumstances surrounding her disappearance, remains in place."
The ABC understands members of the Grimmer family have met with or will soon meet with homicide detectives.
