Steve Bannon facing new criminal indictment in New York

Steve Bannon will face a new criminal indictment in New York and is expected to surrender to authorities on Thursday, according to a report.

The Washington Post reported on Tuesday that Bannon will likely face prosecution in New York for charges similar to those in a federal fraud case that alleged the former White House adviser, and others, defrauded contributors to the "We Build the Wall" fundraising effort, a private project that solicited donations to support the construction of wall along the U.S.-Mexico border.

Charges in that case were dismissed in May 2021 after Bannon received a pardon from former President Donald Trump as one of his last acts in office.

"Just days after being swatted three different times by deranged thugs from New York City inspired by the Biden Administration to assassinate me by police, the Soros-backed DA has now decided to pursue phony charges against me 60 days before the midterm election because WarRoom is the major source of the MAGA grassroots movement," Bannon said a in statement on Tuesday responding to the allegations, shared by his WarRoom podcast colleague Jayne Zirkie.

"The SDNY did the exact same thing in August 2020 to try to take me out of the election. It didn't work then, it certainly won't work now. This is nothing more than a partisan political weaponization of the criminal justice system," the statement continued.

"They are coming after all of us, not only President Trump and myself. I am never going to stop fighting. In fact, I have not yet begun to fight. They will have to kill me first," Bannon's statement concluded.

New York's prosecution against Bannon would be handled by the Manhattan District Attorney's Office and District Attorney Alvin Bragg, a Democrat, and the case would be heard in New York State Supreme Court, according to the report.

The Washington Examiner has reached out to the Manhattan District Attorney's Office for comment.

Bannon's presidential pardon would not prevent him from facing state prosecutions, and only applies to federal charges.

The former Trump strategist pleaded not guilty to federal charges in August 2020 related to the border wall fundraising effort. He was alleged to have made off with $1 million as part of the scheme. Two other men pleaded guilty to related charges in federal court.

Bannon, 68, was found guilty of two counts of contempt in July for failing to comply with subpoenas from the Jan. 6 committee that demanded he turn over documents and sit for testimony. Lawyers for Bannon argued in an appeal that he was unfairly precluded from calling on key witnesses and prevented from leaning on a key defense argument during his trial.
