The Federal court has rejected an urgent application to overturn the India travel ban during a hearing on Monday.

The legal challenge against the India travel ban was brought before the courts by 73-year-old Gary Newman who is stranded in Bangalore.

A total of 9,500 Australians currently in India will not be able to return until after the pause on travel is lifted which is due to occur on Friday.

Justice Thomas Thawley declined to make orders after hearing the first half of the challenge

The emergency declaration made under the Biosecurity Act took effect last week - criminalising the return of travellers from India.
