Democratic New Mexico governor says 'there is no way' to enforce Thanksgiving gathering limits

Democratic New Mexico Gov. Michelle Lujan Grisham said it is impossible to enforce the five-person limit on Thanksgiving gatherings, whether it's in her state or "anywhere in the country."

"You're asking people in New Mexico to limit their gatherings to five. How do you begin to enforce that?" Amna Nawaz, NewsHour's senior national correspondent, asked.

"So, you ask one of the most important questions. You can't enforce that. There is no way, anywhere in the country, we're going to be able to say, 'Look, you brought another household together. There [were] 10 of you having Thanksgiving dinner. But we are hopeful that people will really take heed," Lujan Grisham responded.

New Mexico set emergency health orders that do not allow "more than 5 individuals who do not regularly reside with one another" to congregate until Nov. 30. Residents are also encouraged to shelter in place, and "only essential businesses may open for limited in-person operations."

Other states have implemented similar restrictions ahead of the Thanksgiving holiday, including in New York, where there's a 10-person limit for Thanksgiving celebrations.

Sheriffs in the state have already pushed back on the restrictions, saying they would not enforce them as they can put their resources to better use.

"With regard to the Thanksgiving Executive Order, the Fulton County Sheriff's Office will NOT be enforcing it against our County residents," said Fulton County Sheriff Richard Giardino in a Facebook post after the restrictions were announced. "Frankly, I am not sure it could sustain a Constitutional challenge in Court for several reasons including your house is your castle. And as a Sheriff with a law degree I couldn't in good faith attempt to defend it Court, so I won't."

"We have limited resources and we have to set priorities, so obtaining a Search Warrant to enter your home to see how many Turkey or Tofu eaters are present is not a priority," Giardino added. "We won't be doing that. The only way to enter your residence is if we have a warrant, we are invited in or an exigent or emergency circumstance exist. We have three patrols a shift for 500 square miles, monitoring Family Dinners aren't our priority."

New Jersey is also limiting Thanksgiving gatherings to 10 people, with Gov. Phil Murphy suggesting that the state will be "all over" enforcing the rules when "we can be."

"I or any of us can't be inside your living room for Thanksgiving," Murphy said. "You probably wouldn't want us to begin with, but that does not mean that we, as an enforcement matter, are not going to be as all over it as we can be."
